These Terms of Service govern your access to and use of the Infinite Apps website, applications, integrations, and related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you are accepting these Terms on behalf of a company or organization, you represent that you are authorized to bind that entity.

1. Eligibility and Account Responsibilities

You must be legally able to enter into a binding agreement to use the Service. You are responsible for maintaining the confidentiality of account credentials and for all activities under your account. You agree to provide accurate account information and keep it current.

2. SaaS Subscription and Billing

Certain features require a paid subscription. Subscription fees, billing cycles, and plan features are presented at checkout or in the applicable app marketplace listing. Most payments for our apps are processed through Ecwid and/or Shopify billing systems and/or other partners. Unless otherwise stated, subscriptions automatically renew at the end of each billing period until canceled. You authorize us (or our payment processor) to charge applicable fees, taxes, and required surcharges. You are responsible for all applicable taxes, excluding taxes based on our net income.

3. Trials, Plan Changes, and Cancellations

We may offer free trials or promotional pricing from time to time. After a trial ends, paid billing may begin unless canceled beforehand. You may upgrade, downgrade, or cancel according to the options available in the app dashboard or marketplace. Unless required by law, fees already paid are non-refundable.

4. Acceptable Use

You agree not to, and not to allow others to:

• Use the Service in violation of applicable laws, regulations, or third-party rights.
• Attempt to gain unauthorized access to systems, accounts, or data.
• Interfere with or disrupt the integrity, performance, or security of the Service.
• Reverse engineer, decompile, or otherwise attempt to extract source code, except where prohibited by law.
• Use the Service to transmit malware, spam, or deceptive content.

5. Third-Party Platforms and Integrations

Our Service may integrate with third-party platforms and providers (for example, ecommerce platforms, payment processors, and fulfillment providers). Your use of third-party services is governed by their own terms and policies. We are not responsible for third-party services, including their availability, accuracy, or performance.

6. Customer Data and Privacy

As between you and us, you retain rights to your business and customer data that you submit through the Service. You grant us the rights necessary to host, process, and transmit that data solely to provide, secure, and improve the Service and to comply with law. Our handling of personal data is described in our Privacy Policy.

7. Intellectual Property

The Service, including software, design, text, graphics, and other content, is owned by Infinite Apps or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during your subscription term in accordance with these Terms.

8. Feedback

If you provide feedback, ideas, or suggestions regarding the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate such feedback without restriction or compensation.

9. Service Availability and Changes

We may modify, add, or remove features from time to time. While we aim for high availability, the Service may be unavailable due to maintenance, outages, or events outside our control. We are not liable for delays, interruptions, or losses resulting from such events.

10. Suspension and Termination

We may suspend or terminate your access if you violate these Terms, fail to pay fees, or if continued access presents legal, security, or operational risk. You may stop using the Service at any time. Sections that by nature should survive termination will survive, including payment obligations, disclaimers, limitations of liability, and indemnification.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, secure, or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law, Infinite Apps and its affiliates, officers, employees, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, data, or business opportunities. Our aggregate liability for claims related to the Service will not exceed the total fees paid by you for the Service during the 12 months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Infinite Apps from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

14. Governing Law

These Terms are governed by the applicable laws of the jurisdiction in which Infinite Apps operates, without regard to conflict-of-law rules. You agree to resolve disputes in the competent courts of that jurisdiction, unless otherwise required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date on this page. If changes are material, we will provide additional notice where reasonably possible. Your continued use of the Service after updated Terms become effective means you accept the revised Terms.
